On April 23 2020, before the wording of the heralded executive order (EO) to pause immigration to the US had been finalized in 60 days, US immigration experts had to speculate as to the particulars. President Trump has now signed that EO and the phrasing makes it clear that neither E2 nor EB-5 applicants will be affected.
At the beginning of the meeting, Mr. Trump also made it clear that any second epidemic would not be as bad as it once was or it might not come back. Although earlier comments have been made that the Covid - 19 epidemic combined with seasonal flu will make it more complicated and difficult. The United States is currently the largest epidemic in the world with more than 46,000 deaths in the United States and more than 840,000 cases of Covid - 19.
US President Donald Trump signed the Ordinance "Provisional Prohibition of Entry for Immigrants deemed to be a burden on the US Labor Market while the United States was recovering from the economy after the Covid -19 Pandemic." This statement takes effect at 11:59 PM Thursday, April 23, 2020 and will suspend all entry activities of individuals intending to immigrate to the United States. The following subjects are prohibited from entry to the United States:
- Being outside the United States of America since the effective date of the order;
- There is no valid immigrant visa on the date the decree takes effect;
- There is no valid travel document (such as a shipping letter, boarding pass or permission to return to the United States) before the effective date of the order.
Therefore, this order does not affect the EB-5 investment process nor the processing of this settlement. I-526 approved applications and current priority dates continue as normal.
